Terms

1. Scope and provider

These terms of use apply to the website OpenStage.one and the related API. The provider is:

Daniel Schuster
c/o COCENTER
Koppoldstr. 1
86551 Aichach, Germany
Email: tanuel.mategi@gmail.com

Contact and imprint: imprint. Privacy: privacy policy.

OpenStage is aimed at consumers and businesses. Mandatory consumer-protection rules remain unaffected. Where these terms unreasonably disadvantage the user or are legally invalid, they do not apply and statutory rules take their place.

2. Service – not an organiser

OpenStage is a search portal: hosts list open mics, jam sessions, karaoke and similar sessions so others can find them. We only provide the technical platform. We are not the organiser of listed events, we do not conclude contracts between hosts and guests, and we do not owe the success of any event (whether it takes place, its quality, on-site safety or admission).

The platform is provided free of charge and without a promised availability. Maintenance, outages, force majeure or changes may interrupt access. Features may be added, changed or discontinued where this is reasonable for operations. There is no claim to particular features or uninterrupted access.

Event details (place, time, registration, description) come from hosts. We do not owe completeness, accuracy or currency.

3. Account

An account is created by email/password registration or Google sign-in, in each case with acceptance of these terms. You must provide accurate information, keep credentials secret and notify us without delay if you suspect misuse. Actions via your account are attributed to you to the extent you are responsible for them.

We may temporarily block accounts for breaches of these terms or applicable law or – in case of repeated or serious breaches – terminate them permanently. You can delete the account yourself under Profile → Account.

4. Host content and uploads

4.1 Responsibility

Event titles, descriptions, addresses, dates, profile details and images come from the respective users. You are solely responsible for your content. OpenStage does not review content in advance (no general ex-ante control).

4.2 No unauthorised protected content

You may only post content you have the necessary rights to and that does not violate applicable law. You must not upload, communicate to the public or otherwise use third-party copyright works (in particular photos, graphics, logos, text, music, video) without the rights holder’s permission. This also applies to material from websites, social media, stock platforms or event flyers if you lack the rights. People depicted may only be shown with the required consent where the right of publicity or other personality rights so require.

Also prohibited are in particular insulting, inciting, pornographic, violence-glorifying or otherwise criminal content, misleading event information and infringements of trade marks.

4.3 Duty to prove rights

You warrant that you hold all rights required to post and make your content publicly available. If third parties or we contest that authorisation, you must promptly prove to us on request that you are entitled to use the content (e.g. your own authorship, a licence, consent). If you cannot provide proof, or not in time, we may remove the content or disable access. The statutory burden of proof vis-à-vis external third parties remains unaffected; as between you and us you bear the contractual duty to evidence your chain of title.

4.4 Licence to OpenStage

You grant us a non-exclusive, worldwide, non-transferable right to use the content you post for operating the platform: to store it, process it technically (e.g. crop, WebP/JPEG, Open Graph preview, watermarked infographic), communicate it to the public and – where needed for hosting and display – make it available to subprocessors. The right lasts while the content remains on OpenStage and ends on deletion, except for statutory retention or short-lived backups. You retain copyright. Use beyond operating the platform (e.g. our own advertising outside OpenStage) will not occur without further agreement.

4.5 No claim to publication

We may refuse, shorten, label or remove content where this is necessary for operations, security or legal compliance.

5. Unacceptable use

This includes abusing registration or other people’s accounts; disproportionate automated scraping; bypassing security, quota or blocking measures; malware; posting illegal content; and using the platform to harass or deceive others.

6. Moderation and notices (DSA)

6.1 Process

When content moderation is enabled, newly created or changed event series (title, description, cover) are checked by machine: text and, where applicable, images via the OpenAI Moderation API, covers additionally locally (NSFW detection where available). Hits are not listed publicly for the time being and are reviewed in the fraud centre by a natural person. If moderation is off, new content appears without this pre-check.

Notices and complaints from users are reviewed by a natural person. Possible measures: temporarily hiding from public lists, concealing, removing individual content, temporary account suspension, permanent termination for repeated or serious breaches. We act diligently, objectively and proportionately, taking into account the rights of all parties including freedom of expression (Art. 14 DSA).

6.2 Reporting illegal content

You may report illegal content electronically to tanuel.mategi@gmail.com (Art. 16 DSA). A notice should include:

  1. a reasoned explanation why the content is considered illegal,
  2. the precise URL or other information to locate it,
  3. your name and email address (except for certain sexual offences under Directive 2011/93/EU),
  4. a statement that you are in good faith convinced the information is accurate.

We will acknowledge receipt and communicate the decision without undue delay. You may lodge an internal complaint against moderation decisions by email; statutory remedies remain unaffected. Small platforms are not required to operate a separate standardised internal complaint-handling system under Art. 20 DSA; we still handle complaints by email.

7. Liability

7.1 Unlimited liability

We are fully liable

  • for intent and gross negligence,
  • for injury to life, body or health,
  • under the German Product Liability Act,
  • where we fraudulently concealed a defect or assumed a guarantee.

7.2 Slight negligence

In cases of slight negligence we are liable only for breach of essential contractual duties (cardinal duties) – duties whose fulfilment is a prerequisite for proper performance of the contract and on which you may regularly rely. In that case liability is limited to the typical, foreseeable damage.

Liability for slight negligence in breaching non-essential duties is excluded.

7.3 Further limits where legally permitted

Unless clauses 7.1 and 7.2 provide otherwise:

  • For third-party content (hosts, other users, linked sites) we are liable only in accordance with Art. 6 and 8 DSA and § 7 DDG, in particular not without knowledge of a specific infringement.
  • We are not liable for whether events take place, are cancelled, their quality or on-site safety; that lies with the respective host or venue.
  • We are not liable for data loss to the extent the damage could have been avoided by reasonable backups on your part; you should keep your own content locally.
  • Liability for unforeseeable, atypical consequential damage, lost profits or indirect damage is – outside clause 7.1 – excluded where legally permitted.
  • Where use is free of charge, statutory liability privileges for gratuitous services remain unaffected.

The above also applies in favour of our vicarious agents.

7.4 No exclusion beyond the law

No further exclusion of liability is agreed than German standard-terms law allows vis-à-vis consumers. Invalid parts of this clause do not affect the remainder; statutory rules replace invalid parts.

8. Indemnity

To the extent legally permitted, you will indemnify us against third-party claims arising from your posting content without the necessary rights or otherwise breaching these terms or applicable law. This includes reasonable legal-defence costs. The indemnity does not apply to the extent we ourselves are at fault. Statutory claims remain unaffected.

9. Changes

We may update these terms where needed for operations, legal requirements or clarifications and where this does not unreasonably disadvantage you. The current version is published at this URL. We will inform you of material changes on the website or by email. If you do not object within a reasonable period or continue to use the service, the new version applies where such a fiction is legally permitted; otherwise material changes may require renewed acceptance. Mandatory consumer-protection law remains unaffected.

10. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protections of the country in which you as a consumer have your habitual residence remain unaffected. No venue agreement to the detriment of consumers is made.

If a provision is invalid or unenforceable, the remainder of the agreement stays in effect. Statutory rules replace the invalid provision.
